By accessing and using this website (www.apsispoint.com) and any services provided by Apsispoint™, LLC ("Apsispoint™," "we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
These Terms of Use apply to all visitors, users, and others who access or use our services, including our Managed Detection and Response (MDR) services, incident response services, and the Apsispoint™ platform.

The services and their original content, features, and functionality are and will remain the exclusive property of Apsispoint™ and its licensors. The services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
All threat intelligence, security reports, and analysis provided through our services remain our intellectual property unless otherwise specified in a separate agreement.
Given the sensitive nature of cybersecurity services, both parties agree to maintain strict confidentiality regarding:

Your use of our services is also governed by our Privacy Policy, which is incorporated into these terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your information.
For MDR and incident response services, specific service level agreements (SLAs) including response times, availability guarantees, and escalation procedures will be defined in separate service agreements. Our standard emergency response SLA includes:

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. APSISPOINT™ EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
While we strive to provide the highest quality cybersecurity services, we cannot guarantee that our services will prevent all security incidents or breaches. Cybersecurity is a shared responsibility, and the effectiveness of our services depends in part on your cooperation and implementation of recommended security measures.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APSISPOINT™, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
In no event shall our aggregate liability exceed the greater of one hundred dollars or the amount you have paid us in the twelve months prior to the event giving rise to the liability.
You agree to defend, indemnify, and hold harmless Apsispoint™ and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the services, or b) a breach of these Terms.
We may terminate or suspend your account and bar access to the services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
Upon termination, your right to use the services will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of the State of Maryland and the United States of America, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
